In order to secure conviction in the case against the Chinese galamsey queen who re-entered Ghana without permission after her deportation, Aisha Huang, the prosecution must gather watertight evidence, Member of Parliament for Asante-Akim North, Andy Appiah-Kubi, has said.
Mr Appiah-Kubi said the judge should not be blamed if the prosecution fails to do the job properly in providing incontrovertible evidence in court.
Speaking on the Key Points on TV3 Saturday September 10, he explained that a lot of stakeholders have a role to play in the line of criminal prosecutions.
“There is the investigator, there is the prosecutor and the Judge comes in. The judge can only work based on the evidence that is provided by the prosecution,” he said while calling on the prosecutions to do their work properly.
For his part, a private legal practitioner, Martin Kpebu asked the Attorney General to hire more lawyers for prosecution.
He said most of the prosecutors in the Attorney General’s department are not lawyers hence, the difficulties in securing convictions.
“Most of the prosecutors are not lawyers, we need to make the law better,” he said.
He added “Subsequently, we should know how to refine the law in terms of fine when the galamsey operators are picked up.”
On Monday September 5, an Accra Circuit Court remanded into custody 4 Chinese nationals for their alleged involvement in illegal small-scale mining activities.
Hearing the case Monday September 5, three suspects, Jong Li Huang, Huang Jei and Huiad Hua pleaded not guilty in court to a charge of engaging in sales and purchases of minerals without license.
Aisha Huang who was deported following her involvement in galamsey activities is facing charges of engaging in sale and purchases of minerals without license, as well as mining without license.
She is reported to have returned to the country under a different name. She reportedly applied for a TogoVisa and went through the borders into Ghana to continue her galamsey business in a town in the Ashanti Region.
