The Minority in Parliament has called on the Clerk to Parliament to immediately withdraw the notice sent to the Electoral Commission (EC) declaring the Kpandai parliamentary seat vacant.
On Tuesday, December 9, 2025, Minority MPs dressed in black and held placards to express their strong opposition to the notice. The caucus had earlier opposed the High Court ruling ordering a rerun of the Kpandai parliamentary election. Some of the placards read: “Where is the National Peace Council?” and “Are Journalists on JDM’s Payroll?”
Minority Chief Whip, Frank Annoh-Dompreh, speaking on the floor, argued that the letter to the EC “flies in the face of law and procedural justice.” He stressed:
“We strongly submit to this House that the letter that was sent to the Electoral Commission was out of place, was unfortunate and flies in the face of law and procedural justice. We submit strongly that the letter must be withdrawn by Parliament forthwith… We are totally against it.”
The Kpandai seat was declared vacant following a November 24, 2025, High Court ruling by His Lordship Emmanuel Brew Plange, which ordered a rerun within 30 days. The judgment cited irregularities in voting and collation processes that undermined the credibility of the election outcome.
In a letter to the EC, Clerk to Parliament Ebenezer Ahumah Djietror stated:
“In exercise of the power conferred and the duty imposed on the Clerk to Parliament by Article 112(5), as amended, of the 1992 Constitution, I do hereby formally notify you of the occurrence of a vacancy in the membership of Parliament, occasioned by the Order of the High Court, Tamale, for a rerun of the Kpandai Parliamentary Elections… This notification is pursuant to the service of a court Order on the Clerk to Parliament as the 4th Respondent in Suit Number NR/TL/HC/E13/22/25.”
The legal team of Mathew Nyindam, the embattled MP affected by the ruling, has filed an appeal at the Court of Appeal and a judicial review at the Supreme Court, challenging the High Court’s decision.
