Nyindam heads to Supreme Court to challenge Kpandai election ruling

The Member of Parliament for the Kpandai Constituency, Mathew Nyindam, has filed an application at the Supreme Court seeking to overturn the decision of the High Court, Commercial Division in Tamale, which annulled his 2024 parliamentary election victory.

Nyindam, represented by his lawyer, Gary Nimako Marfo, argues that the High Court exceeded its jurisdiction when it admitted and ruled on a petition filed by the NDC parliamentary candidate, Daniel Nsala Wakpal. Wakpal challenged the results of the December 7, 2024 election in Kpandai.

According to the application, the petition—filed on January 25, 2025—was submitted 32 days after the election outcome was gazetted on December 24, 2024. This exceeds the 21-day statutory deadline stipulated under Section 18 of the Representation of the People Law, 1992 (P.N.D.C.L. 284).

Nyindam contends that the late filing rendered the petition invalid, stripping the High Court of any lawful authority to adjudicate the matter.

“The Parliamentary Election Petition filed by the 1st Interested Party on 25th January 2025, in respect of the Parliamentary Election held at the Kpandai Constituency on 7th December 2024, was invalid and could not have properly invoked the jurisdiction of the High Court, Commercial Division, Tamale,” Nyindam stated in his affidavit to the Supreme Court.

The High Court, on November 24, 2025, nullified the entire Kpandai parliamentary election and directed that a fresh election be conducted within 30 days. Nyindam is now asking the Supreme Court to issue a judicial review in the nature of certiorari to quash the ruling, as well as all related processes arising from what he describes as an “invalid petition.”

The Supreme Court is expected to hear the matter on Tuesday, December 16, 2025. Nyindam’s legal team insists the case raises a critical question of jurisdiction, arguing that allowing the High Court ruling to stand would undermine the statutory timelines governing election petitions and the proper administration of justice.

Nyindam was declared winner of the Kpandai seat with 27,947 votes (53.47%), defeating the NDC candidate, Wakpal, who secured 24,213 votes (46.33%).
