I’m Also Preparing My Petition for Kissi Agyebeng’s Removal – Kpebu

Private legal practitioner Martin Kpebu has revealed that he is preparing a petition seeking the removal of the Special Prosecutor, Kissi Agyebeng, from office.

Speaking on TV3’s The Key Points on Saturday, December 1, Kpebu said he believes he has solid grounds—including allegations of incompetence and corruption—to petition for the Special Prosecutor’s removal.

“I am also petitioning for the removal of Kissi Agyebeng… on the grounds of corruption and incompetence,”
he stated.

His comments come in the wake of reports that 10 petitions have already been submitted to President Mahama, who has since forwarded them to the Chief Justice, Justice Paul Baffoe-Bonnie, for a determination of a prima facie case.

According to a report by the Daily Graphic on Monday, December 1, seven petitions are seeking the removal of the Chairperson of the Electoral Commission (EC), Jean Mensa, and her two deputies—Dr. Bossman Eric Asare (Corporate Services) and Samuel Tettey (Operations).

The remaining three petitions target the Special Prosecutor, Kissi Agyebeng.

Checks by Graphic Online’s Emmanuel Ebo Hawkson indicate that all petitions have already been transmitted to the Chief Justice.

Under Article 70(2) of the Constitution, the President appoints the EC Chairperson and deputies on the advice of the Council of State. Their terms and conditions of service mirror those of judges of the superior courts.

The EC Chairperson has the same conditions of service as a Justice of the Court of Appeal, while the two deputies enjoy conditions equivalent to those of a Justice of the High Court. Consequently, their removal processes follow the strict constitutional procedures outlined for superior court judges.
