Nyindam’s Lawyers to Appeal High Court Ruling on Kpandai Rerun

Lawyers representing Kpandai Member of Parliament, Matthew Nyindam, have expressed their disagreement with the Tamale High Court’s decision ordering a rerun of the Kpandai parliamentary election.

The ruling, delivered by His Lordship Emmanuel Brew Plange on Monday, November 24, cited irregularities in the voting and collation processes that allegedly undermined the credibility of the December 7, 2024 election results. The suit was filed by Daniel Nsala Wakpal, the National Democratic Congress (NDC) candidate, who argued that 41 out of 152 polling stations in the constituency showed inconsistencies in Form 8A (Statement of Polls for MPs), affecting the outcome.

In response, Nyindam’s counsel, Sylvester Esang, filed a motion of appeal seeking a stay of execution. He said:

“We anticipated this judgment. While we respect the decision of the court, we disagree with it. We are totally dissatisfied with the ruling. Commonsensically, if you take out 500 votes and add them to the petitioner, he still would not win the elections. On what basis then does a court annul results?”

Esang added that the legal process allows them to escalate the matter to the Court of Appeal, emphasizing that dissatisfaction with a judgment is part of the judicial hierarchy.

The High Court has directed that the rerun election be conducted within 30 days. The Electoral Commission is expected to announce the date for the fresh poll.
