Lawyers for former Director-General of the National Signals Bureau (NSB), Kwabena Adu-Boahene, have expressed disappointment following the Supreme Court’s dismissal of their motion seeking to prohibit Justice John Eugene Nyante Nyadu from presiding over their client’s ongoing trial.
A five-member panel of the Supreme Court on Thursday unanimously dismissed the application, describing it as “lacking in merit” and holding that it failed to meet the legal threshold for disqualifying a trial judge.
Speaking to journalists after the ruling, Lead Counsel Samuel Atta Akyea said that although the outcome was disappointing, his team remained undeterred in their pursuit of justice.
“I am disappointed but not discouraged. We will see how the case will travel. The persuasion a judge should have is the law. I will have a banter or fight with the judge. I am only going to project the law, and that doesn’t move me at all,” Mr. Atta Akyea stated.
The case, which involves allegations of causing a financial loss of $49 million to the state, will continue before Justice Nyante Nyadu at the High Court in Accra.
