Private legal practitioner Kwame Adofo has urged former Finance Minister Ken Ofori-Atta to consider legal action against the Office of the Special Prosecutor (OSP) for what he describes as an unjustified declaration of him as a “fugitive from justice.”
Speaking on Asaase Radio’s *The Forum* on Saturday, February 15, Adofo criticized the OSP’s handling of high-profile cases, accusing the Special Prosecutor of exceeding his legal authority.
He argued that the OSP lacks the legal basis to declare an individual a fugitive, especially when no formal charges have been brought against them.
“I don’t see where the OSP derives the power to label someone a fugitive from justice. This action is baseless and should never have happened. Ken Ofori-Atta has not been formally charged, yet he has been publicly defamed. This provides strong grounds for legal action,” Adofo asserted.
He further suggested that Ofori-Atta’s legal team should consider suing the Special Prosecutor personally.
Adofo also cited past cases, including the investigation into former Minister Cecilia Dapaah—later dismissed by the courts—as evidence of the OSP’s inefficiency. He argued that the Special Prosecutor’s investigative approach is flawed and undermines the institution’s credibility.
“What kind of serious investigator announces an investigation before even beginning? He did the same with the NPA case. Such tactics only allow people to conceal evidence and obstruct investigations. This is clear incompetence, and he should be removed,” Adofo stated.
He further questioned the Special Prosecutor’s effectiveness since assuming office in 2021, asking, “We are now in 2025—can he justify his tenure? Has he secured even one conviction in four years?”
Adofo called on the government to reassess the leadership of the OSP, arguing that the current Special Prosecutor has failed in his mandate and should either step down or be dismissed.
“The credibility of the OSP is on the line, and the government must take action to restore public confidence in the institution,” he concluded.
