Ato Forson’s Legal Team Files for Mistrial Citing Attorney General’s Misconduct in Ambulance Case

Lawyers for Hon. Ato Forson have filed a supplementary affidavit in support of a motion for an order of mistrial, injunction, and/or stay of proceedings in the ongoing ambulance procurement case. The motion, submitted to the court, is bolstered by a trending recording of a telephone conversation between Mr. Jakpa and the Attorney-General, Godfred Dame. The recording allegedly contains evidence of criminal and prosecutorial misconduct by the Attorney-General.

In addition to the recording, the affidavit references several quotations from media reports, particularly by Asaase Radio, which allege professional misconduct on the part of the Attorney-General. These media excerpts have been annexed to the legal filing as supporting evidence.

Hon. Ato Forson contends that the Attorney-General’s actions constitute reprehensible and unlawful behavior, unbecoming of the Minister for Justice. Forson asserts that the Attorney-General’s sole aim is to secure his conviction through unethical means. He argues that if the court proceeds with the trial despite these serious allegations, it would result in a gross miscarriage of justice and undermine public confidence in the judicial system.

Forson’s legal team emphasizes that the court must act in the interest of justice, which must not only be done but must also be perceived to be done. They stress that ignoring the Attorney-General’s misconduct would signal a dangerous tolerance for breaches of the rule of law and prosecutorial ethics by high-ranking officials.
