High Court dismisses lawsuit filed by Rockson-Nelson Dafeamakpor to compel Speaker of Parliament and President to act on LGBTQ+ bill within 7 days

Rockson-Nelson Dafeamekpor’s request for a Mandamus seeking to compel the Speaker of Parliament Alban Bagbin and President Nana Addo Dankwa Akufo-Addo to act on the LGBTQ+ bill within seven days has been dismissed.

The High Court in Accra presided over by Justice Ellen Lordina Serwah Mireku said, though the court has jurisdiction to hear the mandamus, two pending cases before the Supreme Court challenge the processes of parliament which is a constitutional matter for the apex Court to address.

The Court is of the considered view that it will be “inappropriate” for the High Court to compel the respondents to act on the Bill when the basis of the case is pending before the apex Court.

The applicant – Rockson Dafeamekpor through his lawyers led by Nii Kpakpo Samoa was asking the Court to compel President Nana Akufo-Addo and Alban Bagbin to act on the bill within seven days.

State Attorneys led by Sylvia Adesu said the action is premature for the Court to interfere with matters between Parliament and the Presidency when the bill has not been assented.

EIB Network’s Legal Affairs Correspondent, Murtala Inusah, reports that a mandamus application is a request seeking the court to compel a public officer to perform its public functions.
