Sensible Decision Demands Resignation from Controller and Accountant-General – Edudzi Tameklo

Godwin Edudzi Tameklo, Director of Legal Affairs for the National Democratic Congress (NDC), contends that common sense should have guided Controller and Accountant-General, Kwasi Kwaning-Bosompem, to resign following his public declaration to contest in the parliamentary primaries of the New Patriotic Party (NPP). Edudzi emphasized that civil servants participating openly in politics erode the credibility of their office.

“He needs to exercise common sense, given the critical nature of his role. I anticipated him demonstrating self-restraint by resigning… the involvement of civil servants in politics openly undermines the integrity of the offices they hold,” he remarked on TV3’s Key Points on Saturday, January 13.

Private legal practitioner Martin Kpebu also advised Kwaning-Bosompem to seek informed legal counsel regarding the appointment of civil servants in Ghana. Kpebu criticized Kwaning-Bosompem’s reliance on Article 195, stating that it reflects a lack of understanding of the law.

After citing Article 195 of the Constitution of Ghana, 1992, as the basis for not resigning, Kwaning-Bosompem asserted his intention to remain in office while contesting the Akim Swedru parliamentary seat. Kpebu, however, urged him to obtain proper legal guidance, highlighting that Article 195 applies to all public service positions.

“Article 195 is applicable to all offices in public service, even janitors. They are all appointed under 195, but the distinction lies in the fact that junior officers don’t have their letters signed by the president. If he claims his appointment is under 195, he has said nothing substantial. He should tread cautiously; is this an appropriate defense?” argued Kpebu on TV3’s Key Points.

In a separate interview, Kpebu urged the public to persist in pressuring the Controller and Accountant-General to resign, enabling him to pursue his political ambitions. He cautioned against falling for potential excuses, suggesting that continued public pressure could prompt a voluntary resignation. Kpebu emphasized that Article 195 encompasses all civil service appointees, emphasizing their importance to the constitutional framework.
